1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and GPT CV Scoring regarding your use of our AI-powered CV scoring and resume analysis service (the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, store, and analyze your User Content solely for the purpose of providing and improving the Service.

You represent and warrant that:

You have the right to upload and share the User Content
The User Content does not violate any laws or third-party rights
You have obtained necessary consents for processing personal data in the User Content

5.2 Our Intellectual Property

The Service, including its original content, features, functionality, design, AI models, and technology, is owned by GPT CV Scoring and protected by international copyright, trademark, patent, and other intellectual property laws. These Terms do not grant you any rights to use our trademarks, logos, or other proprietary information.

6. Subscription Plans and Payments

The Service may be offered through various subscription plans with different features and usage limits. By subscribing to a paid plan, you agree to:

Pay all fees associated with your selected plan
Provide accurate billing and payment information
Authorize us to charge your payment method for the subscription fees
Understand that subscription fees are billed in advance and are generally non-refundable
Accept that pricing may change with reasonable notice

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period.

7. AI and Service Accuracy

AI-generated scores and recommendations are provided for informational purposes only
Results may not always be accurate or complete
You should exercise independent judgment when making hiring decisions
We are not responsible for any hiring decisions made based on our Service
The Service should be used as a tool to assist, not replace, human evaluation

8. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.

You are responsible for ensuring compliance with applicable data protection laws (including GDPR, CCPA) when using the Service, particularly regarding candidate data and personal information you upload.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GPT CV SCORING AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless GPT CV Scoring and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

Your use or misuse of the Service
Your violation of these Terms
Your violation of any third-party rights
User Content you upload or transmit

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:

Your right to use the Service will immediately cease
We may delete your account and associated data
All provisions of these Terms that by their nature should survive termination shall survive

We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
